CONTROLLED SUBSTANCE, ALCOHOL, CONTRABAND ARTICLE POLICY

 

The use of controlled substances and alcohol endangers the user and co-workers.  Standard Maintenance Company, LLC will not allow controlled substances or alcohol on its premises, facilities or work places.  A controlled substance is any drug or drug like substance whose sale, use or possession is unlawful; except by prescription.  Any prescribed substance, used without a prescription is also a controlled substance.

 

SMC will not allow individuals who are under the influence of alcohol or controlled substances on its premises, facilities, or work places.  SMC will not allow drug paraphernalia, firearms or unauthorized explosives on its premises, facilities, or work places.

 

SMC may find it necessary to conduct searches and drug screening to help in the control or detection of drug or alcohol usage.  These searches and/or tests may be utilized in, but not limited to the following circumstances.

 

1.   When an employee's supervisor has reasonable suspicion that the employee is intoxicated, or is using or working under the influence of alcohol or controlled substances.

 

2.   When physical evidence of controlled substances, alcohol, or paraphernalia is noted.

 

3.   Pre-employment or employment entrance examinations.

 

4.   Part of overall search and inspection of the company's premises, facilities and work places.

 

5.   Following an accident that requires outside medical treatment or a potentially serious accident in which careless acts were performed the test(s)/search may be part of the investigation.

 

6.     When required by the client.

 

7.    As part of a random drug or alcohol screening program.

 

Any individual testing positive or found to be in possession of controlled substances, alcohol or other contraband articles will be subject to disciplinary action up to and including discharge.


 

SUPPLEMENTAL INFORMATION

Testing

 

Will be conducted by a laboratory, which is certified by or, follows the standard of the College of American Pathologists.  Listed below are laboratories that meet the above criteria and an itemization of "controlled substances."

Test Cost

 

The employee will not be responsible for analytical test costs.

 

The employee will be compensated for time spent testing on the scheduled test date.

 

Should an individual test positive for controlled substances, that employee's separation slip will indicate:  "Violation of Company Policy".

 

Termination /Rehire

 

A positive test, results in termination of employment.

 

The company will consider rehiring a terminated employee after 180 days if that individual:

      A.  Discontinues use of controlled substances.

      B.   Re-tests negative.

 

The company will consider rehiring a terminated employee after completing rehabilitation if

that individual:

      A.  Discontinues use of controlled substances.

      B.   Re-tests negative.

 

The company will consider rehiring a terminated employee after 30 days if that individual:

      A.  Discontinues use of controlled substances.

B.    Individual brings in certified copy of testing results that show negative results. (This test is done at that individual’s expense.)

 

 

The company cannot guarantee a job to an employee seeking to be rehired.  Constraints, such as non-availability of work and lack of a vacant position compatible with the employee's skills, must be considered.

 

If an employee tests positive and feels that outside help is needed to solve the problem, the company will assist in locating counseling, if assistance is requested by the employee.  The company will not pay for any counseling, rehabilitation, or self help services.

 

Drug testing records are confidential, and will not be disclosed except as legally required.

 

 

Agreement to Consent to Testing/Search

 

Any applicant or employee who refuses to agree to a testing/search as requested by SMC will be refused employment or terminated.
